Limited Communicable Disease Exclusion No. 3 (Property Treaty Reinsurance - Risk)
The LMA Property Reinsurance Business Panel has published the attached model exclusion:
This endorsement is based on the already published Limited Communicable Disease Exclusion No.1 (LMA5502) and Limited Communicable Disease Exclusion No.2 (LMA5503) and has been drafted for use on more complicated commercial risks.
As with all LMA model clauses, it is purely illustrative and is distributed for the guidance of LMA members, who are free to agree to different conditions or amend as they see fit.
This exclusion is available on the Lloyd’s Wordings Repository (LWR), which can be accessed via www.lloydswordings.com.
The LMA has already published the following model clauses: a Coronavirus Exclusion (LMA5391), which emanated from the Personal Accident market (Accident & Health); a Communicable Disease Endorsement (LMA5393) for use on property contracts; a Communicable Disease Exclusion (LMA5394) for use on property treaty reinsurance contracts; a Coronavirus Exclusion (LMA5395) for use on marine and energy liability contracts; a Communicable Disease Exclusion (LMA5396) for use on liability policies; a Communicable Disease Exclusion (LMA5397) for use on power generation, construction and engineering policies; an Infectious or Contagious Disease Exclusion (LMA5398), for use on UK consumer and commercial property risks; a Communicable Disease Exclusion (LMA5399), for use on casualty treaty reinsurance; an Infectious or Contagious Disease Exclusion during a declared Public Health Emergency (LMA5500), for use on consumer and commercial accident/accident & illness policies; a Political Risk Communicable Disease Exclusion (LMA5501); two Limited Communicable Disease Exclusions (LMA5502 and LMA5503), for use on property treaty reinsurance; and an Occupational Disease and Cumulative Trauma Endorsement (LMA5504), for use on reinsurance agreements covering workers’ compensation business in the US.
The LMA continues to work with various Business Panels/Committees who have requested variants of the coronavirus clause and/or communicable disease language for their class of business. The LMA is, as usual, aiming for a common format/structure and consistency of language across LMA model clauses drafted in response to COVID-19.
