Active Assailant Event Other Insurance Endorsement Published for Combined Terrorism/Event Cancellation Polices
The LMA has published a model other insurance endorsement, LMA5660, on behalf of the
LMA Terrorism and Political Violence Panel. LMA5660 is designed for combined terrorism/ event cancellation policies that cover ‘active assailant events’ as a named peril.
The other insurance provision in LMA5660 is triggered if the insured is also covered for losses resulting from an ‘active assailant event’ by an all-risks event cancellation policy. In this situation, the combined terrorism/ event cancellation policy will act as the primary policy with respect to such losses.
Please note that when using LMA5660, the term ‘active assailant event’ should be replaced where necessary to match the policy language used in the contract to which the endorsement will be attached. For example, ‘Active Assailant Event’ may be replaced with ‘Deadly Weapon Attack’ or ‘Active Shooter Event’.
All LMA model documents are purely illustrative and are published and distributed for the guidance of Lloyd’s managing agents, brokers and other market participants. All contracting parties are free to agree to different conditions/amend the model documents as they see fit; the LMA does not protect its intellectual property rights over model documents. Underwriters decide whether any contractual language is acceptable for any given risk.
