London, 03 December 2025: The Lloyd’s Market Association (LMA) has launched the Emerging Litigation Forum (ELF), which succeeds the Environment and Climate Change Litigation Committee (ECLIC).
The new Forum expands the scope of its predecessor to cover a wider range of insurance-related emerging litigation trends. While climate and environmental cases will remain a key area of focus, ELF will also explore other categories of litigation that are increasingly relevant to the Lloyd’s market.
The decision to transition ECLIC into ELF reflects both the slow-moving nature of climate litigation and growing member interest in broader emerging litigation risks. In keeping with the structure of LMA forums, specific working groups may be established where sufficient member interest develops in particular areas.
The Forum held its first meeting on 28 October, featuring legal experts who presented on two hot topics. The first examined the recent surge in PFAS litigation in the US and drew comparisons with asbestosis claims in the US. The second was an up-date on PFAS developments outside the US, including an examination of the history of water pollution litigation in the UK culminating in the recent River Wye case.
John Levett, Head of Regulatory Affairs at the LMA, said: “The establishment of the Emerging Litigation Forum reflects the growing need for the market to engage with a wider set of litigation risks. This group will enable LMA members to share insight and expertise, helping the market remain informed and prepared for developments in an increasingly complex litigation landscape.” The Forum will continue to circulate a newsletter following its sessions, providing members with insight into recent cases and discussions.
