Updated Contingency Model Wordings Published

The LMA’s Contingency Committee has published the following updated model wordings:

Each of the five model wordings listed above contains a minor amendment to the terrorism, civil commotion, communicable disease and cyber exclusions, respectively. The second limb of each exclusion now reads:

“any action taken in controlling, preventing, suppressing or in any way relating to any [Act of Terrorism/Civil Commotion/Communicable Disease/Cyber Act or Computer System Failure], or the fear, or threat, of any such event.”

The ‘Requisition of the Venue’ exclusion in LMA3163A, LMA3164A, LMA3165A and LMA3166A has also been amended to include a carve-back for requisition of the venue “as a sole and direct result of a cause not otherwise excluded”.

The exclusions and conditions within LMA3122B have been updated to align with those in LMA3163A. The insuring clause for ‘Requisition of the Venue’ has also been amended, replacing the term “natural catastrophe” with “a cause not otherwise excluded”.”

The updated model wordings are available via the Lloyd’s Wordings Repository and the previous versions have been archived. All LMA model documents are purely illustrative and are published and distributed for the guidance of Lloyd’s managing agents, brokers and other market participants. All contracting parties are free to agree to different conditions/amend the model documents as they see fit; the LMA does not protect its intellectual property rights over model documents.
