The US version of the Non-Appearance Insurance Medical Questionnaire is, in relation to the substantive medical questions asked, the same as LSW1917. The differences in the wording relate to the privacy notice at the beginning and the authorisation provided by the insured for the information to be used by insurers. This was reviewed by US counsel.
The notice has been drafted so that it is suitable for use in California, Washington, New York and Tennessee. It may also be suitable for use in other states. However, it does not function as a full privacy policy; managing agents will need to ensure their firm privacy policies comply with the data protection requirements in the state where the business is being written. This is because the privacy notice at the beginning of the wording acts only as a signpost to those privacy policies. Lloyd’s mandated state-required data protection notices may also apply (for example, in California).
In addition, prospective insurers to any policy must ensure copies of their firm’s privacy policy are lodged with the relevant coverholder or broker so they can be provided to the insured on request. The coverholder or broker should also be made aware that these documents must be provided upon request. This applies to followers as well as leads.
