LMA launches Environment and Climate Litigation Committee

The LMA has convened a new Environment and Climate Litigation Committee (ECLiC) to inform and guide members in identifying important aspects of climate-related liability claims. At the first meeting on 12 January 2024, committee members agreed to a new Terms of Reference and an approach to sharing information going forward. Attendees also had opportunities to hear briefly from legal professionals working on ongoing trends and the latest cases.

The committee’s objectives are to:

  • give opportunities to hear from and meet external lawyers and experts on key legal issues arising from climate change liability claims facing the market, which will be shared more widely through appropriate channels
  • consider issues arising out of existing or proposed climate change and environmental-related requirements of Lloyd’s, and the UK and overseas regulators
  • represent the interests of practitioners in this area with Lloyd’s, regulatory authorities and organisations in the UK and overseas.

Environmental and climate-related liability claims have the potential to be significant in number and scope during the coming years. This committee will support the existing Sustainability Committee’s work and also assist the market in understanding these litigation risks. Greater understanding in the market is essential to our members facilitating the transition to net zero.
